SITUATION
This SIB only pertains to authorized BMW centers that are located in the State of California.
The Safe Drinking Water and Toxic Enforcement Act of 1986 [California Proposition 65, aka Prop 65] is a California law which requires businesses to provide clear and reasonable warning before they expose any individual to a chemical known to the state to cause cancer or reproductive toxicity. Listed chemicals may also be used in manufacturing and construction, or they may be byproducts of chemical processes, such as motor vehicle exhaust.
Starting August 30, 2018 all vehicles including used vehicles and vehicle components, sold in California and containing any of the Prop 65 chemicals, have to be provided with a warning of health risks by hazardous substances, that may be present during the operation, servicing and maintenance of passenger cars, on the component or packaging. In addition, a corresponding warning must be included in the owner's manual.
CORRECTION
These requirements apply to the following types of vehicles sold only in the state of California:
- New vehicles in inventory
- Certified Pre-Owned (CPO) and used vehicles in inventory
- New, CPO, or used vehicles obtained via a dealer trade from within; or outside of California
For further information on this law, as well as a list of the Prop 65 chemicals, refer to the official website: www.P65Warnings.ca.gov/passenger-vehicle.
4 possible labels may be required:
- Temporary warning label on the driver's door glass: All vehicles, new and used vehicles
- Warning label in the printed owner's manual: All vehicles produced through June 2018
- Warning label on the driver's B-pillar: Diesel-engine vehicles only
- Additional warning label in the printed owner's manual: Diesel-engine vehicles only
PROCEDURE
- A temporary warning label must be applied to the front door window on the driver's side. Apply during QC1 (new vehicle) or when preparing a CPO vehicle for display.
The label is permitted to be removed by the customer only after the completion of the sales transaction. The label material consists of a non-permanent adhesive.
NOTE: All new vehicles designated for California centers which are processed at the Vehicle Distribution Center in Oxnard, Ca. as of late August 2018 will arrive with the label already in place.Position the label onto the inside glass surface near the rear of the window.
The actual label has light grey print on a clear background which faces outward so that the warning information is legible to the customer before entering the vehicle.
Actual size is approx. 2 1/4" high x 7 3/4" wide.
Position and apply the label so that it does not block the glass identification markings (arrow).
- A permanent warning label must be applied to the owner's manual during QC1 (new vehicle) or when preparing a CPO vehicle for display.NOTE: New vehicles produced as of July 2018 (which can be either the 2018 or 2019 model year) already have the warning printed in the Owner's Manual.
On vehicles produced through June 2018, apply the label to the inside rear cover (arrow), towards the center seam. The actual label size is approx. 3 1/2" high x 3 3/4" wide.
- Diesel-engine vehicles require a permanent label, applied to the bottom of the B pillar. Apply during QC1 (new vehicle) or when preparing a CPO vehicle for display.
Position the label (arrow) above the Manufacturer's Safety Compliance (aka VIN) label.
Align the left edge of the Diesel label with the left edge of the VIN label.
The actual label size is approx. 3/4" high x 4" wide.
- Diesel-engine vehicles require a second permanent label, applied to the owner's manual. Apply during QC1 (new vehicle) or when preparing a CPO vehicle for display.
Apply the label to the inside rear cover below (arrow) the general warning label, and towards the center seam.
The actual label size is approx. 3 1/2" high x 3 3/4" wide.
NOTE:- No diesel engine BMWs are offered for the 2019 model year.
- The Integrated Electronic Owner's Manual already contains the general warning, per the path My Vehicle, Owner's Manual, for your own safety, then scroll to California Proposition 65 Warning.
